General terms and conditions (GTC)

§ 1 Scope

These GTC apply to all contracts between HK-Enterprise GmbH, Ewald-Holt-Straße 8, 49716 Meppen and the customer — both for consumers (§ 13 BGB, German Civil Code) and for businesses (§ 14 BGB).

§ 2 Conclusion of contract

The presentation of the products does not constitute a binding offer. By clicking "Order with obligation to pay", the customer submits a binding offer to purchase. The contract is concluded when the seller confirms by email or dispatches the goods.

§ 3 Prices and payment

All prices are in euros including VAT. The following payment methods are available:

PayPal
Credit card (Visa, Mastercard, American Express) — via PayPal Plus
SEPA direct debit — via PayPal Plus
Purchase on invoice — via PayPal Plus (subject to credit check)
Klarna (invoice within 30 days and instalment purchase)
Apple Pay
Sofortüberweisung (instant bank transfer)
Payment in advance by bank transfer (payment term: 7 days)
Invoice for business customers after approval with proof of business registration

For payment in advance, the amount must be transferred within 7 days.

§ 4 Delivery and shipping

Shipping within 1–2 working days via DHL and WKS Logistik. Delivery to Germany and selected EU countries. For consumers, the seller bears the shipping risk.

§ 5 Retention of title

The goods remain the property of the seller until full payment has been made.

§ 6 Right of withdrawal for consumers

Consumers have a statutory right of withdrawal. Details can be found on the cancellation policy page.

Businesses do not have a statutory right of withdrawal.

§ 7 Warranty

7.1 Towards consumers

Statutory liability for defects. Limitation period: 2 years from delivery.

7.2 Towards businesses

Limitation period: 1 year. Defects must be reported in writing within 5 working days (§ 377 HGB, German Commercial Code).

§ 8 Limitation of liability

Unlimited liability for intent, gross negligence and personal injury. In cases of slight negligence, liability applies only in the event of a breach of essential contractual obligations and is limited to foreseeable damage.

§ 10 Dispute resolution

The EU online dispute resolution (ODR) platform was discontinued on 20 July 2025. We do not participate in dispute resolution proceedings.

§ 11 Final provisions

German law applies. The place of jurisdiction for businesses is Meppen.
